The “All of Me” actress, Neri Naig and ex-Star Magic road manager, Danilyn Nunga were ordered arrested by the Cebu City RTC for wrongly accusing two people on their Instagram account.
The Regional Trial Court (RTC) of Cebu City released a warrant of arrest today, February 11 against the former Star Magic road manager, Danilyn Nunga and actress, Neri Naig associated with the libel case filed by the complainants versus the two of them.
According to the Sun Star Cebu, the arrest warrant was penned by Cebu City RTC Judge Ricky Jones Macabaya.
The warrant of arrest was linked to the previous Instagram post of Danilyn on April 30, where the photos of Donna Marie Go and Clarence Taguiam appeared and falsely accusing the two of “bogus online seller” after Danilyn bought a Go Pro Hero 3 online.
Apparently, Neri re-posted the same in her Instagram account what Danilyn had posted. Attributed to the circumstances, Donna Marie and Clarence decided to file a complaint of libel against Danilyn and Neri under R.A. 10175 or Cybercrime Prevention Act of 2012. The Cebu City Prosecutor’s Office formally filed the libel case against the two last October 2015.
Nevertheless, Neri and Danilyn already withdrew and erased what they have inaccurately posted on their personal Instagram account referring to Clarence and Donna Marie. In connection with the libel case, Danilyn requested for the postponement of the court proceedings until further investigation of the complaint filed against them (Nunga and Neri Naig) will be done.
However, Judge Macabaya did not uphold on their request, but instead based on his two-page order he cited: “The grounds asserted by Nunga that she was deprived of due process for they were not afforded a preliminary investigation or not given the opportunity to submit a counter affidavit deserves a scant consideration.”
